There are a few things you should know about DUI bail bonds in Fullerton, so let’s cover that.
What happens when someone is arrested for a DUI in Fullerton?
When someone is arrested for a DUI in Fullerton, they are typically taken to the Fullerton Police Department and placed in a holding cell while they are being processed and until they have sobered up. The booking process involves such things as a mug shot, being fingerprinted and a warrant check.
How much does a DUI Bail Bond Cost in Fullerton?
For first time DUI offenders, the scheduled bail amount is $2,500. Usually first timers (within a 10 year period) are cited out and given a court date. If a person does not have a California license they might not be cited out. If required to post bail it could be posted in cash for the full $2,500 or a non-refundable fee of $250 could be paid to a Fullerton bail bond company.
For a suspected second DUI offense, the scheduled bail amount is $10,000.
Bail could be posted in either of two ways:
1. A person could post the full $10,000 directly with the jail. The $10,000 would be forwarded to the court and held until the judge orders the money to be returned. Cash bail may be applied towards fines depending on who deposited the money and whether or not a waiver was signed to authorize payment of fines from the bail money. If a portion of the cash bail is to be returned it will take 6-8 weeks from the date of the court order.
2. A person could get a bail bond in the amount of $10,000 by contacting a Fullerton Bail Bonds company. The fee for a $10,000 bail bond is $1,000. This is a one time, non-refundable fee.
The scheduled bail amount for a suspected third DUI offense is $15,000. A $15,000 bail bond could be posted in either of the two ways mentioned above. The cost for a $15,000 bail bond would typically be $1,500 and can be paid by cash, check or credit card.
What services does a bail bondsman provide in exchange for their fee?
The primary service a bail bondsman provides is they post the full bail amount so the person can be released from custody. The bail bondsman provides a financial guarantee to the court that the defendant will make each and every court appearance they are required to make.
The bail bondsman will require someone to sign a Bail Bond Agreement. This is usually a friend or family member of the person in jail. By signing the Bail Bond Agreement, they are agreeing to be financially responsible for any costs resulting from the defendant’s failure to appear in court. If the defendant does not return to court within 6 months the person who signed for the bail bond will be responsible for paying the full bail amount.
How long does it take to get released from the Fullerton Police Department’s Jail?
One determining factor is the warrant check or LiveScan results. This can take an hour or several hours depending on how busy the system is. With DUI’s however, release may be delayed 4-6 hours or more to allow the person’s blood alcohol level to return to a normal level.
